All articles offered for auction are offered “AS-IS”/”WHERE IS”, in units of measure announced by the auctioneer. All sales will be final. Auctioneer will only accept bids from registered bidders with an assigned bidder number. All bidders must be registered. Bidders will be identified by number during the auction.
Auctioneer has the authority and final say in deletion, distribution, grouping, order, and organization of lots to be sold. Auctioneer has final say as to the fall of the hammer and sold price. Once items have been sold, ownership immediately transfers to the winning bidder who is responsible for their own purchase and payment of it. A buyer’s premium (12% for live auctions/13% for online auctions) will be added to the final sales price of all sales unless otherwise announced.
Any announcement at the start of the auction supersedes anything previously expressed by Auctioneer. All auction attendees will hold harmless seller and auctioneer for any injury or accident occurring before, during, after, or in association with sale of items and auction. Buyer will complete their own due diligence and will not hold Auctioneer responsible or liable for any errors or omissions. All items are to be paid in full, and then removed the day of auction (closing date will be set for real estate). Items not removed within 24 hours of sale are considered abandoned and will be disposed of at Auctioneer’s sole discretion, in any manner deemed appropriate to Auctioneer. All person’s (over the age of 18) entering the auction premises, whether registering to bid or not, must have either a bidder number or an auction pass. All minors must be accompanied by an adult. Since some or all auctions may be recorded, all attendees agree to be photographed, recorded, &/or videotaped without further consent, compensation, or consideration from the attendee, even when products of such recordings are used in future marketing by auctioneer. By signing Bidder Registration, bidder acknowledges and accepts all terms and conditions.
If bidding on real estate: Buyer will not hold seller or Auctioneer responsible for buyer failing to understand or gain knowledge of any zoning, licensing, permits, or other restrictions which may be affected by the intended use of their purchase. A deposit in the form of cashier’s check for 10% of appraised value is required to register. Deposit will be forfeited by buyer/winning bidder in the event that sale fails to close by contract close date. No Realtors or licensed agents will be registered nor compensated for attendance or procuring cause the date of the auction. No Realtors or licensed agents will be permitted to attend the auction without an auction pass. Bidders or Bidder’s agent must register agent 5 days or more prior to auction date in order to receive co-op commission. No bidders nor real estate agent shall make representations to other bidders, solicit buyers/bidders, distribute information of any kind whether written or verbally anywhere at auction location. If found doing so agent and bidder will be banned from future sales. All parcels are to be sold in the manner of cash within the specified term of the contract. If bidder is financing, arrangements must be made so that cash distribution happens the day of agreed upon closing. No extensions will be given. All forms required by the state in which the auction is held will be completed as a condition of sale. All fair housing and state and local housing laws will be adhered to.
